What Are Partner Visa Sponsorship Limitations?

Australian migration law places limits on certain family visa sponsorships. These rules may affect Australian citizens, permanent residents or eligible New Zealand citizens who want to sponsor a partner, spouse or prospective marriage visa applicant.

In many partner visa matters, a sponsor may need to consider whether they have previously sponsored another person, whether they were previously sponsored themselves, and whether enough time has passed before a new sponsorship can be approved.

Two Sponsorship Limit

A person may generally be limited to two approved partner, spouse, fiancé or interdependent partner sponsorships.

Five-Year Rule

A sponsor may be restricted from sponsoring another partner until at least five years have passed from the earlier visa application date.

Compelling Circumstances

In some cases, sponsorship limitations may be waived if there are compelling circumstances affecting the sponsor.

Who May Be Affected?

Sponsorship limitation issues may arise for applicants and sponsors involved in:

  • Partner Visa subclass 820 or 801
  • Partner Visa subclass 309 or 100
  • Prospective Marriage Visa subclass 300
  • Previous spouse, de facto partner or fiancé sponsorships
  • Cases where the sponsor was previously sponsored as a partner

Common Sponsorship Limitation Issues

A sponsorship issue does not always mean a visa application must fail. However, it may require careful legal and factual assessment. Common issues include:

  • The sponsor has previously sponsored a spouse or partner.
  • The sponsor was previously granted a partner visa themselves.
  • Less than five years has passed since an earlier partner visa application.
  • The sponsor has already sponsored two previous partners.
  • The sponsor needs to rely on compelling circumstances.
Important: Sponsorship limitation rules can be complex and depend on visa history, application dates, previous grants, relationship history and current migration legislation. Always obtain professional advice before lodging a partner visa application.

Can Sponsorship Limitations Be Waived?

In some circumstances, a sponsorship may still be approved even where a limitation applies. Examples may include situations involving a dependent child, the death of a previous partner, abandonment by a former spouse, or a longstanding new relationship.

Every case is different. Strong supporting evidence is usually important when asking the Department to consider compelling circumstances.
